Our client was arrested by Keller Police Department for changing lanes and charged with the offense of Driving While Intoxicated-Open Container. After selecting a jury, we raised a motion to suppress the evidence in the case due to the fact that our client did not change lanes illegally and in fact, stayed within his lane. Both sides made arguments before the Court and the Judge ultimately found that there was not reasonable suspicion to pull the client over. Based on that ruling, the Court suppressed the evidence in the case and granted the Defendant a directed verdict of not guilty.
