The consideration is what is likely to happen at a jury trial, and if it is likely that they are going to be convicted, and what are the costs after conviction, such as fines and court costs. If it is a jury trial then we take that case all the way through jury trial, and we do not charge the client more, because they say they wanted a jury trial.
